CHINA INTERNATIONAL ECONOMIC AND TRADE ARBITRATION COMMISSION

On the afternoon of February 25, 2025, China International Economic and Trade Arbitration Commission (CIETAC) South China Sub-Commission successfully held the first arbitrator training session and Spring Gathering of 2025. The training session invited Li Fang, senior arbitrator of CIETAC and the founding partner of Beijing Tianyuan Law Firm, to share on the theme "Determination of Contract Validity". Secretary General Wei Ziping of CIETAC South China Sub-Commission delivered the opening speech, and Deputy Secretary-General Jin Xi presided over the session. Approximately 50 CIETAC arbitrators from the Greater Bay Area attended the event.

 

 

Secretary-General Wei Ziping first welcomed all the arbitrators attending the training and provided a detailed introduction to the work of CIETAC and CIETAC South China Sub-Commission in 2024. She noted that 2024 was a year of significant achievements for CIETAC and CIETAC South China Sub-Commission. The number of new cases accepted and the amount in dispute both increased substantially. Types of disputes were concentrated in key areas such as construction projects, real estate development,  and finance, with the cases further internationalized. Arbitrators from the Greater Bay Area had more opportunities to participate in handling cases, and were more capable to hear foreign-related cases. While reached another record high in various business indicators, CIETAC South China Sub-Commission actively engaged in external cooperation, further enhancing its influence in the Greater Bay Area. Secretary-General Wei Ziping expressed her gratitude to all arbitrators for their hard work in 2024 and outlined the key tasks for 2025. She emphasized that CIETAC South China Sub-Commission would always remember its mission to serve national development strategies and the construction of the Greater Bay Area. Together with all arbitrators, they would continue to provide more efficient, professional, and full services of arbitration for the parties involved, and jointly promote the high-quality development of the arbitration industry in the Greater Bay Area.

 

 

During the sharing, Arbitrator Li Fang, drawing on his years of case-handling experience, introduced and shared insights on the key issue of determining the validity of contracts. He systematically reviewed the legislation on the validity of contract from the time of the Contract Law to the Civil Code, analyzed key legal provisions and judicial interpretations, and shared their application in specific cases related to factoring contracts, fund contracts, trust contracts, and other capital market-related fields. Subsequently, the participating arbitrators engaged in an in-depth discussion on practical issues related to the determination of the validity of contract, such as VAM (Valuation Adjustment Mechanism) Agreement.

 

 

During the discussion session, the participating arbitrators congratulated CIETAC South China Sub-Commission on its achievements in the past year and offered constructive suggestions and opinions on optimizing case management processes, improving information technology construction, diversifying arbitrator training activities, and further enhancing the influence of CIETAC South China Sub-Commission.

The training and gathering was lively and achieved significant results. All colleagues from CIETAC South China Sub-Commission participated in the training and meeting.
